Terms and Conditions (T&C) for the Online Store "Deinspar Limited"

 

1. BACKGROUND

1.1 These Terms and Conditions ("T&C") apply when you place an order with us as a consumer ("Customer") via www.deinspar.com and associated pages ("Website"). The contract is concluded between you and Deinspar Ltd, registered in England and Wales, Company Number: 14900703 ("Deinspar"). Detailed contact information and other details about Deinspar can be found on the Website. The T&C apply only to customers who place an order.

1.2 Customers must be at least 18 years old to order via the Website. In accordance with legal provisions, Deinspar does not accept credit purchases from individuals who have not yet reached the age of 18. Deinspar reserves the right to reject or amend a customer’s order (e.g., if the customer provides incorrect personal details and/or has outstanding debts).

1.3 Deinspar is not liable in the event that products are out of stock, nor for image or printing errors on the Website, such as errors in product descriptions or technical specifications, incorrect pricing and price adjustments (due to changes in supplier prices, currency fluctuations, etc.), or incorrect information regarding product availability. Deinspar has the right to correct such errors and change or update the information at any time. If a wrong price was displayed for a product ordered by the customer, Deinspar will inform the customer accordingly and wait for the customer's confirmation of the corrected price before continuing the order process. All images on the Website are for illustration purposes only. It is not guaranteed that these illustrations reflect the quantity of products delivered to the customer or the exact appearance, function, or origin of the product. Deinspar is not responsible for third-party information provided on the Website.

1.4 The Website and all its content are the property of Deinspar or its licensors. The information is protected by copyright and trademark law. This means that trademarks, company and product names, images, graphics, design, layout, and information about products and services, as well as other content, may only be reproduced or used with prior written permission from Deinspar.

2. CONTRACT AND ORDERS

2.1 In order to place an order via the Website, the customer must accept the T&C. By accepting the T&C, the customer agrees to comply with them fully and confirms that they have read the information regarding personal data and cookies, and consent to their use in accordance with Deinspar's privacy policy as outlined here.

2.2 A purchase contract is concluded once Deinspar confirms the customer’s order and the customer receives an order confirmation via email from Deinspar. Deinspar recommends that the customer keep the order confirmation for any future order-related contacts with Deinspar customer service. The customer has the right to cancel an order as long as Deinspar has not yet confirmed it. In the event of order cancellation, Deinspar will refund all payments made by the customer, their bank, or credit card company regarding the order.

3. CUSTOMER INFORMATION, ETC.

3.1 When you visit Deinspar.com and place an order, Deinspar processes your personal data to provide you with the best possible Website experience and to conclude the purchase contract. You confirm that the information you provide is correct and complete, and that you are responsible for any incorrect or incomplete data. Information about the processing of personal data by Deinspar can be found in our privacy policy.

3.2 The customer is responsible for ensuring that no other persons use their login details. The customer's username and password must not be shared with third parties. The customer must ensure that documents containing the username and password are stored in a way that unauthorized individuals cannot access them. The customer must immediately notify Deinspar if there is any suspicion that unauthorized persons have gained access to the customer's password. If this notification is not made, the customer is responsible for any purchases made with their login details.

3.3 If Deinspar suspects that the customer is misusing their account or login details, or is otherwise violating the T&C, Deinspar reserves the right to deny the customer access to their user account. Deinspar also has the right to assign new login details to the customer.

4. PRICES, FEES, AND PAYMENTS

4.1 The prices displayed on the Website apply to orders placed via the Website. All prices are inclusive of VAT and are quoted in Euros (EUR). Payment fees and shipping costs are not included in the prices and will be stated separately.

4.2 The customer pays for their order in the manner indicated on the Website. Deinspar has the right to charge the customer's account at the time of order, unless a purchase on account or a similar payment method has been chosen and confirmed by Deinspar. After invoicing or partial payment, Deinspar or its partners may request a credit report from third parties. In such cases, the customer will be informed accordingly. Deinspar reserves the right not to offer all payment methods or to change the payment method if the chosen method is unavailable at the time of order execution. The limitations of available payment methods are indicated on the Website.

5. SPECIAL OFFERS

Deinspar may occasionally post special offers on the Website, which may include more favorable terms than those set forth in these T&C, such as payment conditions or an extended right of withdrawal. Such terms apply for the duration of the special offer and for the products designated by Deinspar for such offers. Deinspar reserves the right to withdraw these special offers at any time. After the expiration or withdrawal of a special offer, these T&C apply without any additions. Any offers for specific products on the Website apply only for a limited time and until the products are sold out.

6. DELIVERY AND SHIPPING

6.1 Products in stock are usually delivered within the number of business days indicated on the Website. Unless otherwise agreed (e.g., if out-of-stock products are reserved), delivery will take place no later than 30 business days after Deinspar's written order confirmation. 6.2 The expected delivery time is indicated in the order confirmation, during the payment process, and/or on the relevant product page of the Website. Unless expressly agreed otherwise, and in the case of a delivery delay of more than 30 business days not caused by the customer, the customer has the right to cancel the order.

6.3 If a shipment is to be picked up at a specific delivery location, the customer must do so within the timeframe stated in the notification. Shipments are usually to be picked up in person upon presentation of a valid ID and the order number. The customer will receive a delivery notification indicating when and where the shipment can be picked up or received. This notification may be sent by email, mail, phone, or SMS if the customer has provided a mobile phone number. Deinspar has the right to charge the customer a handling fee of EUR 35 if the shipment is not picked up.

7. RIGHT OF WITHDRAWAL AND RETURNS

7.1 When purchasing products through the Website, the customer has a right of withdrawal of 14 days according to applicable consumer protection laws. The customer can withdraw from the purchase within 14 days after receiving the product by informing Deinspar in writing about their withdrawal.

7.2 Products for which the right of withdrawal does not apply are explicitly shown to the customer before completing the purchase. The right of withdrawal also expires for sealed products once the customer removes the seal. This includes, in particular:
(a) Items with protective packaging where removal makes a return impossible, such as frames with non-renewable plastic glass protection.

7.3 If the customer wishes to exercise their right of withdrawal, they must inform Deinspar clearly before the withdrawal period expires. The name, address, and relevant details such as order number, invoice number, and product name must be provided. Alternatively, the customer can use the standard withdrawal form from the consumer protection authority.

7.4 If the customer cancels a purchase, they are responsible for the return shipping costs. Returns must be sent to the following address:

The product must be returned within 14 days of the withdrawal declaration and be in good condition, preferably in the original packaging. The customer is responsible for the product's condition until it reaches Deinspar. Additional fees, such as customs or VAT costs, incurred when receiving or returning the product, are to be borne by the customer.

7.5 Deinspar commits to issuing a refund within 14 days after receiving the product or a return proof. The refund will be made via the original payment method used by the customer unless otherwise agreed.

Note: If the customer returns the product after the 14-day withdrawal period or if a loss occurs during the return process, Deinspar is not obliged to accept the product or issue a refund.
At the footer of the Website, there is an option to initiate a return. Through this function, the customer can check if a return is possible. For damaged goods, the customer has the option to upload images and resolve the case directly with customer service.

8. WARRANTY AND COMPLAINTS

8.1 Some of Deinspar’s products come with warranties. Information about the warranty periods and specific warranty conditions for individual products can be found on the Website. The warranty applies solely to manufacturing defects and does not cover damages caused by individual modifications such as redesigns, improvements, or other alterations to the product. The order confirmation serves as the warranty certificate.

8.2 The right to file a complaint applies to products that are defective under applicable consumer protection laws. A customer wishing to exercise their complaint rights must contact Deinspar immediately after discovering the defect.

8.3 In the case of an accepted complaint, Deinspar will cover the return shipping costs of the product.

8.4 If a complained product has been returned and the complaint is accepted, Deinspar will refund the customer in accordance with applicable consumer protection laws. The refund is generally issued within 30 days after the complaint is received, though it may take longer in some cases. Deinspar reserves the right to reject complaints if the product is not considered defective under consumer protection laws.

9. LINKS

Deinspar's Website contains links to third-party websites. These websites are not under the control of Deinspar and are provided solely for the customer’s convenience. Deinspar is not responsible for the content of third-party websites and cannot be held liable for damages resulting from visiting those sites.

10. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the UK. Any dispute between the parties shall be subject to the jurisdiction of the UK courts.

11. CHANGES TO THE TERMS AND CONDITIONS

Deinspar reserves the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions will be posted on the website. The changes will take effect once the customer agrees to the updated Terms and Conditions (either by placing a new order or by continuing to use the website) or 30 days after the customer is notified of the changes. However, Deinspar recommends that the customer regularly checks the website for updates and changes to the Terms and Conditions.

12. SEVERABILITY CLAUSE

If any provision of this agreement is deemed invalid or unenforceable by a competent court, arbitration panel, or authority, the remaining provisions of this agreement will remain fully valid and enforceable in accordance with applicable laws. Any provisions deemed invalid or unenforceable will be replaced by the relevant legal provisions.

13. APPLICABLE LAW AND DISPUTE RESOLUTION

13.1 Conflict resolution: Disputes should primarily be resolved through discussions with Deinspar's customer service.

13.2 Mediation platform: If a dispute cannot be resolved through discussions with Deinspar's customer service, the customer can file a complaint directly through the EU Commission's online mediation platform. You can find the link here. When you submit a complaint through this mediation platform, it will automatically be forwarded to the relevant national dispute resolution authority. This authority will then contact us to resolve the dispute as much as possible without involving a court. In disputes, Deinspar always follows the decision of the relevant dispute resolution authority.

13.3 Judicial resolution: Disputes regarding the interpretation or application of these Terms and Conditions will be decided as outlined in section 13.2 or ultimately by a court.
